Separate Opinions of Judges and the WTO: Lost Opportunities

Abstract

The possibility of expressing separate opinion is one of the key guarantees of judicial independence of international judges. Separate opinions contribute to the development of international law. The members of panels and Appellate Body of the WTO Dispute Settlement Body are entitled to give separate opinions, but only anonymously. That is why there were only few separate opinions in DSB practice.
